Immigration reform: Which states would feel it most? California, for one.

If immigration reform is implemented, and newly documented workers start paying taxes, the money flowing into state coffers will increase, as will the demands on state social services.

With immigration reform now firmly on the agendas of both the Senate and White House, a key question is how to assess its possible impact on states, particularly in two of the most important areas, the labor market and fiscal policy.

Who will be the most affected? While every state would feel some effect, the states with the most illegal immigrants are the most obvious to register the impacts of any changes to immigration law. California tops that list with nearly a quarter of the nation?s illegal immigrant population of roughly 11 million.

Ultimately the most significant political impact California would feel would be a slew of new Democratic voters, Steve Camarota, director of research at the Washington-based Center for Immigration Studies, says with a laugh.

But while that may affect elections many years in the future, he says, the two places to watch for the more immediate impact of immigration reform are in fiscal policies and the labor market.

As the newly legal residents begin to pay taxes, they will eventually qualify for state health and welfare benefits, which will raise costs to the state. Beyond that, this same pool of workers ? 80 percent of whom do not have education beyond a high school level ? will compete directly with the native population of workers with similar education and skill levels for jobs that have demanded documented legal status.

?California already has a very low level of participation in the work force by this group between the ages of 18 and 29,? he says. He notes that in 2000, the native-born cohort of workers in that age group and with no more than a high school education was 64 percent. Last year, that figure dropped to 43 percent. ?This is below the national average of some 50 percent,? he says, adding that reforms would greatly increase the numbers of workers who can compete at that level.

?Now you will have many more people competing for low wage jobs such as the local security guard at an office building or a UPS delivery person,? he adds.

On the flip side, this influx of documented workers would fill tax coffers in many states, in particular the ones with large undocumented populations, Texas and Florida being the next largest after California, points out Ian Macdonald, co-chair of the global mobility and immigration practice at the law firm Littler Mendelson.

?This will have a direct impact on state funding for health care and education, as well as on certain industries such as construction, agriculture, hospitality, and others where unskilled workers are needed,? he says via e-mail.

New burdens of government paperwork to process applications for legal status are sure to cost current state budgets, while requirements for employers to screen applicants for that status may bring their own problems, he says. A question currently on the table is whether to make E-Verify, a digital screening tool, mandatory for employers to use on new hires only or on the entire workforce, notes Mr. Macdonald.

By having employers run both existing and new hires through this comprehensive database, many employers will likely find that many of their existing employees were in fact undocumented workers who had escaped detection, he says. This could be a hardship for a company experiencing a sudden drain on its employee base.

Some politicians support this, he notes, adding that US workers will no longer be competing against undocumented workers ?and good corporate citizens will no longer be competing against companies that build business models around undocumented cheap labor.?

Appeals court faults EPA for soot regulation

(AP) ? An appeals court is siding with environmental groups that had challenged Environmental Protection Agency regulations on soot as too weak.

The three-judge panel ruled Friday that the EPA regulated soot of a certain size under weaker cleanup requirements than it should have.

The environmental groups, including the Natural Resources Defense Council, had challenged two rules dating back to the George W. Bush administration. The court sent the rules back to the EPA with instructions to strengthen them.

Soot, or fine particulate matter, is microscopic pollution released from smokestacks, diesel trucks and other sources. Breathing it can cause lung and heart problems, contributing to heart attacks, strokes and asthma attacks.

Two of the three judges were appointed by Republican presidents, the third by a Democrat.

Rory McIlroy may skip the 2016 Olympics because of a problem over which country to represent.

The No. 1-ranked player from Northern Ireland is eligible to compete for either Britain or Ireland when golf returns to the Olympics in Rio de Janeiro. He said he may miss the games to avoid having to choose between the two.

"I just think being from where we're from, we're placed in a very difficult position," the 23-year-old McIlroy said in a BBC documentary. "I feel Northern Irish and obviously being from Northern Ireland you have a connection to Ireland and a connection to the U.K."

McIlroy stirred controversy last year when he said in a British newspaper interview that he felt "more British than Irish." He then posted a clarification on Twitter saying he grew up "a proud product of Irish golf" and had not made a decision on the Olympics.

"If I could and there was a Northern Irish team I'd play for Northern Ireland," he said in the BBC program. "It's a tough one, whatever decision I make - whether it's play for Ireland, play for Britain or not play at all, maybe, just because I don't want to upset too many people.

"It's definitely an option. I either play for one side or the other or I don't play. Those are the three options that I have and I'm still considering them very carefully."

McIlroy, who has twice represented Ireland at the World Cup, was asked whether he regretted saying last year that he felt more British.

"It was a moment, I don't want to say of weakness, but of frustration with it all," he said. "People tune in to watch me play on TV and feel like they are connected to me in some way. I don't want to repay them for their support by doing something that they wouldn't want me to do.

"When I do make a decision, it's going to be one that I've thought long and hard about, and one I feel comfortable with."

Story Philosophy: The Story of Ferdinand: animal rights, violence ...

The Story
The Story of Ferdinand?tells of a young, peaceful bull, who lives in a pasture with his mother and a large group of other young bulls. All the other bulls like to run and buck all day long, but he prefers to sit under his favourite tree and smell the flowers. When five scary men come to take the meanest bulls away, Ferdinand stays calm and content, assuming the men will not choose him. Suddenly, a bee stings Ferdinand. Startled, he loses control, bucking and fussing more than anyone else! Assuming that he is a very fierce bull, the men take Ferdinand away against his will, and they force him into the fighting ring. However, they become very angry when they find he refuses to fight?

The Philosophy in the Story
Our society puts a lot of emphasis on teaching children to make ?ethical choices,? but it would be difficult for any of us to determine a clear set of criteria that makes an action ?right? or ?wrong? each time.?The Story of Ferdinand?is an example of a young protagonist who grows up very comfortable in his own skin and with his own decisions, but is soon confronted with difficult situations that challenge his peaceful way of life. Young children can use Ferdinand?s story to confront their own questions about ethical dilemmas. Each question set deals with the larger issue of how we make choices in our interactions with others, but this question can be broken up into more specific topics. Looking at how the men interact with Ferdinand can spark a discussion on Animal Rights. The next three topics deal with Ferdinand?s choices, rather than the men?s. Ferdinand?s passivity informs a discussion on Violence. Considering why Ferdinand does not follow the other bulls? example of rough play leads to a discussion on Conformity. Finally, examining why Ferdinand does not follow the men?s orders leads to a discussion on Obeying Authority.

Animal Rights
The first question set deals specifically with interactions between species. Our society teaches us that humans have the right to use non-human animals for our own purposes as we see fit. Most humans view themselves as somehow ?higher? or more important than all other animals, but they have a difficult time justifying why they feel this way. Does this concept need to be re-examined? Most students will agree that Ferdinand should not have been taken away and hurt, but they may disagree about whether or not his species makes a difference, and if so, why. If Ferdinand were a human, there would be little debate that the abuse he suffers is a crime. However, many reason that species membership is an arbitrary distinction that should not be the basis for how one is treated, no more than should race, gender, ethnicity, and so on. Illustrating this standpoint, philosopher Jeremy Bentham, the founder of modern utilitarianism, maintained that the question is not ??Can they reason?,? nor ?Can they talk,? but ?Can they suffer??? Contemporary philosopher Peter Singer agrees that while species membership is not a distinguishing moral characteristic, sentience ? that is, self-awareness and ability to suffer ? is. We know that non-humans suffer acutely, both physically and mentally ? for instance, mother cows will bellow hysterically when their calves are taken away from them, showing clear signs of distress long afterwards. If we agree that taking Ferdinand from his mother and his home and hurting him for our entertainment is wrong, then we must ask ourselves whether it is ever okay to exploit animals ? for our entertainment, for our clothing, for our cosmetic products, for our food, or for anything else - and if so, how we decide when and why it is okay.

Ferdinand wants to stay with his mother and sit quietly under his favourite tree, but the five men come and take him away to hurt him and make him fight.


  1. How do you think the men were able to make Ferdinand come with them even though he did not want to? Were they right to do this? Why or why not?
  2. Does being?able?to do something mean you?should?do it? Why or why not?
  3. If not, what is something you could do but should not do? Why?
  4. Are animals here for our entertainment?
  5. Do we have a responsibility to respect and/or to protect animals?
  6. What is more important: What Ferdinand wants to do, or what the fighting men want him to do? Why?
  7. If Ferdinand were a human being, would your answer be different? Why or why not?
  8. If someone hurt a person who has the same skin color as you, would you be more upset than if someone hurt someone who was very different from you? Would it matter if they were shorter, taller, younger, or older than you? Why or why not?
  9. Which would make you more upset, someone hurting a close friend of yours, or someone hurting a stranger? Why?
  10. Why do some kinds of differences seem to matter when we decide how we treat each other, while other differences do not?

When the men come, Ferdinand is calm because he assumes they will not choose him, but when a bee stings him and he bucks, the men take him away.


  1. Why do the men believe that Ferdinand is fierce?
  2. Can we know what someone is thinking or feeling just by watching his/her behavior? Do you ever think you can tell what your pets are thinking? If so, how? If not, why not?
  3. Do the men ask how Ferdinand feels? Should they?

Violence

The second question set deals with violence in general, which should certainly be considered regarding interactions between humans and non-humans, but also among humans themselves. Children are taught from an early age ?don?t fight,? but it is sometimes difficult to tell what this means. What about in self-defense? In considering Ferdinand?s reaction to the violent men who want to ?stick? him with pins and spears, students can debate ways to respond when someone else initiates a fight. Some argue that once someone has been provoked, any kind of violence can be justified if committed in self-defense. Others maintain that violence is never acceptable. For instance, many advocate?ahimsa, or ?no harm,? a Sanskrit term that is the foundation of many Eastern philosophies. A subscriber to?ahimsa, like Mahatma Gandhi, a peace activist and celebrated pioneer of passive resistance, would maintain that a nonviolent response is always more appropriate. While we teach the general mantra, ?don?t fight,? television, video games, and other forms of entertainment tend to portray a violent lifestyle as the norm and as something to admire and emulate. Sometimes some forms of ?fighting? can be healthy forms of play, like when children wrestle together. However, does this mean that there is something wrong with not enjoying rough play or violent video games? Parents and educators have been disputing through the ages whether violent play and entertainment is healthy or not; here is a chance for children to add their voices to the debate.

  2. Do you think certain types of fighting can be fun? When and how? Why or why not?
  3. Is fighting ever the right thing to do? Is it ever the wrong thing to do? When? How do you know?
  4. Is it ever okay not to fight back when someone wants to fight with you? Why or why not?
  5. What should you do if you don?t want to fight, but someone tries to start a fight with you?
  6. Do the answers to questions #2-#5 depend on whom you are fighting?
  7. Does it matter if the one you are fighting is weaker or stronger than you?
  8. Can a fight ever be fair? What makes it fair or unfair? Explain.

  1. Have you ever had fun watching someone else fight? (hockey, wrestling, kickboxing ? bullfighting!) What makes it fun?
  2. Is it still fun to watch if someone gets really hurt? Why or why not?

Conformity

Children, especially males, often grow up socialized to believe that they should be ?tough,? and this can manifest itself in a number of assumptions about how we should behave. Amidst a cohort of young bulls who like to beat each other up all day long, Ferdinand is the lone, sensitive bull who prefers to smell the flowers. At first, when Ferdinand?s mother sees all the other young bulls playing a certain way and sees Ferdinand behaving differently, she worries that something is wrong, but when she understands that he is happy, she relaxes. Ferdinand?s mother ultimately decides that it is okay for Ferdinand to be different, but her initial concerns reflect the underlying ethical question of whether there is something inherently good or bad about conforming to social norms. Some argue that social norms originate outside the self and thus should not govern how the individual behaves, while others maintain that social norms serve an important role in regulating our behavior to best serve the interests of society.

Students will often decide that it is completely okay for two different groups (or a group and one ?outlier?) to enjoy different things, but some may argue that it is important for peers all to behave the same way in certain situations. The discussion on conformity can focus specifically on peer pressure and bullying, which is especially appropriate in a school context and can be combined with the discussion on violence (see above). If everyone else around you is doing something, can you assume that it is okay? When phrased this way, it may seem that the answer is clearly ?no.? However, given specific situations, our answers may become more complex. After all, we model our behavior on those around us, and so it can be difficult to determine when to follow and when to protest. One interesting activity would be to go around the circle and have each student think of a time in which they felt different from everyone around them. Most likely, everyone has felt this way at some point, and there will be those who feel this way most of the time. We could structure an entire session on the nature of ?feeling different? and the ethical issues it raises.

(AP) ? With reggae music pumping in the background and flashing disco-style lights, members of the recreational pot club lit up in celebration of the new year ? and a new place to smoke legally among friends.

Club 64, in an industrial area just north of downtown Denver, opened at 4:20 p.m. on Monday, with some 200 people signed up. The opening came less than 24 hours after organizers announced they would charge a $29.99 admission price for the bring-your-own pot club.

"Look at this!" Chloe Villano exclaimed as the club she created over the weekend opened. "We were so scared because we didn't want it to be crazy. But this is crazy! People want this."

The private pot dens popped up less than a month after Colorado's governor signed into law a constitutional amendment allowing recreational pot use. Club 64 gets its name from the number of the amendment.

Two Colorado clubs were believed to be the first legal pot dens in the nation. The Denver Post reported that a similar pot club opened earlier Monday in the small southern Colorado town of Del Norte.

Colorado's marijuana amendment prohibits public consumption, and smoke-free laws also appear to ban indoor smokeouts. But Club 64 attorney Robert Corry said private pot dens are permissible because marijuana isn't sold, nor is it food or drink.

Villano, the club owner, said the pot club would meet monthly at different locations, with the $29.99 membership fee good for only one event. On Monday, the pot club was meeting in a hemp-based clothing store near downtown. Hooded sweatshirts and backpacks were shoved to a corner. In the main area, a few small tables sat next to a screen showing "The Big Lebowski."

A bar decorated with blue Christmas lights handed out sodas and Club 64's official snacks ? Goldfish and Cheetos. The snacks were inspired by Colorado Gov. John Hickenlooper, who warned marijuana users the night of the marijuana vote, "don't break out the Cheetos or Goldfish too quickly."

Corry said the pot clubs are intended for people who can't use marijuana at home because of local ordinance or because their landlords threaten eviction.

"It's just a place for adults to exercise their constitutional rights together," Corry said. "We're not selling pot here."

Among the new Club 64 members planning to ring in the New Year was Joe Valenciano of Denver. He heard about Club 64 a day ago and signed up immediately.

"We need more clubs like this," Valenciano said.

Details of tentative deal averting 'fiscal cliff'

Highlights of a tentative agreement Monday between the White House and Senate Minority Leader Mitch McConnell, R-Ky., aimed at averting wide tax increases and budget cuts scheduled to take effect in the new year. The measure would raise taxes by about $600 billion over 10 years compared with tax policies that expire at midnight Monday. Still unresolved is how to avert across-the-board spending cuts set to begin slashing the budgets of the Pentagon and numerous domestic agencies.

Highlights include:

?Income tax rates: Extends decade-old tax cuts on incomes up to $400,000 for individuals, $450,000 for couples. Earnings above those amounts would be taxed at a rate of 39.6 percent, up from the current 35 percent. Extends Clinton-era caps on itemized deductions and the phase-out of the personal exemption for individuals making more than $250,000 and couples earning more than $300,000.

?Estate tax: Estates would be taxed at a top rate of 40 percent, with the first $5 million in value exempted for individual estates and $10 million for family estates. In 2012, such estates were subject to a top rate of 35 percent.

?Capital gains, dividends: Taxes on capital gains and dividend income exceeding $400,000 for individuals and $450,000 for families would increase from 15 percent to 20 percent.

?Alternative minimum tax: Permanently addresses the alternative minimum tax and indexes it for inflation to prevent nearly 30 million middle- and upper-middle income taxpayers from being hit with higher tax bills averaging almost $3,000. The tax was originally designed to ensure that the wealthy did not avoid owing taxes by using loopholes.

?Other tax changes: Extends for five years Obama-sought expansions of the child tax credit, earned income tax credit, and an up to $2,500 tax credit for college tuition. Also extends for one year accelerated "bonus" depreciation of business investments in new property and equipment, a tax credit for research and development costs and a tax credit for renewable energy such as wind-generated electricity.

?Unemployment benefits: Extends jobless benefits for the long-term unemployed for one year.

?Cuts in Medicare reimbursements to doctors: Blocks a 27 percent cut in Medicare payments to doctors for one year. The cut is the product of an obsolete 1997 budget formula.

?Social Security payroll tax cut: Allows a 2 percentage point cut in the payroll tax first enacted two years ago to lapse, which restores the payroll tax to 6.2 percent.

After a LONG day, the Senate has overwhelmingly voted to approve a Fiscal Cliff deal, sending legislation for final approval in the House.

There was a little nervousness this evening that liberals might not be on board the deal, but the bill passed easily 89-8.

The basic gist is: taxes will rise for individuals making $400K or more and families making $450K or more.

These thresholds are higher than Democrats would like, but Democrats are getting an Unemployment Insurance extension, as well as an extension of other credits.

There is also a permanent fix to the Alternative Minimum Tax indexing.

As for the "sequester" that will be delayed for two months.

This part is infuriating conservatives, who see the spending cuts delayed once again, while taxes rise on many Americans (even though the income taxes will stay low for most taxpayers, payroll taxes will rise).

Senate Majority Leader Harry Reid took the floor briefly to inform lawmakers that negotiations are still ongoing, but that they don't have anything to vote on yet.?

"There are still some issues that need to be resolved before we can bring legislation to the floor," Reid said. "Negotiations are continuing as we speak."?

"We really are running out of time," he added. "Americans are threatened with a tax hike in a few hours."

Harkin, a staunch liberal, took the Senate floor after Reid, and blasted his party for making too many concessions on the fiscal cliff ? specifically by raising the threshold for extending the Bush tax cuts to $450,000, up from the $250,000 that President Barack Obama campaigned on.?

"This looks like a very bad deal."?

Harkin's sentiments have been echoed by many Democrats, who are frustrated with last night's developments. After talks failed in the Senate yesterday, fiscal cliff negotiations turned into a backroom affair between Senate Minority Leader Mitch McConnell and Vice President Joe Biden. According to reports, Biden also agreed to concede to Republican demands on the estate tax, in addition to agreeing to raise the income threshold for the Bush tax cuts.?

Washington Post blogger Ezra Klein has a pretty brutal takedown of the White House's leadership on the fiscal cliff. The gist of his argument is that while Obama entered the fiscal cliff negotiations with the apparent advantage, he has caved every step of the way.?

Here's the key passage:?

The Republicans plan to say that now that they broke their pledge and voted for a tax increase, they?ll insist on a dollar of spending cuts for every dollar of debt-ceiling increase ? the so-called ?Boehner rule?. The White House plans to insist that it won?t negotiate over the debt ceiling at all.

Republicans I?ve spoken to laugh at this bluster. Obama is already negotiating over the debt ceiling, they point out. He began the fiscal cliff negotiations by saying he wanted a permanent solution to the debt ceiling. Then it was a two-year increase in the debt limit. Now he?s going to sign off on a mini-deal that doesn?t increase the debt ceiling at all. Does that really sound like someone who?s going to hold firm when faced with global economic chaos? The White House always talks tough at the beginning of negotiations and then always folds at the end. Republicans are confident that the debt ceiling will be no different.

Slate blogger Matt Yglesias has a similar take here. The White House, Ygelesias argues, lost any credibility it had by putting the debt ceiling on the table despite insisting that Obama wouldn't negotiate on raising the debt limit. Even worse, by including the debt ceiling in a "grand bargain" package delayed until 2015 , the Obama White House is actually institutionalizing the practice of negotiating on the debt ceiling.?

The AP reports that a deal could be imminent, but that both sides are still at odds over how to deal with the sequester,?the package of dramatic budget cuts scheduled to go into effect at midnight.?

According to the AP, the deal would include returning tax rates for households earning over $450,000 to 39 percent, the same rate that they were under President Bill Clinton. The deal would also extend unemployment benefits and raise the tax on estates over $5 million from 35% to 40%.?

But Republicans are pushing for the fiscal cliff deal to include a three month delay of the sequester, and want to use the Chained CPI to offset the cuts. Democrats want to push back the sequester until 2015, and use new revenues to pay for the cuts.?

CNN reporter Dana Bash tweets that Democrats are pushing hard against Republican demands, and are now?saying they will block any bill that includes a three-month delay, part of a ploy to keep Vice President Joe Biden from agreeing to the measure.?

The White House just announced that President Obama will speak in the South Court Auditorium at 1:30 p.m.?

According to the schedule update, Obama will "deliver remarks at an event with middle class Americans," so it doesn't sound like he will be announcing a deal, although reports indicate that a deal is imminent.?

CNBC and other news outlets are reporting that the two sides have reached an agreement on the threshold for extending the Bush tax cuts.?

Sam Stein and Ryan Grim have more details on the emerging deal here. Here are some of the key elements, according to their report:

1. The Bush-era tax cuts will be extended permanently to 39.6 percent for individuals earning more than $400,000 and households earning more than $450,000.?That same threshold would be applied for capital gains and dividends, with the top rate going up to 20 percent.?Estimated revenue: $370 billion over 10 years.?

2. ?The estate tax will go up slightly for estates over $5 million, from 35 percent to 40 percent. Estimated revenue: $25 billion in revenue over 10 years.?

3. Personal tax exemptions would be capped at $375,000 for individuals and $425,000 for households. Itemized deductions would be capped at $250,000 and $300,000 respectively. Estimated revenue: $185 billion over 10 years.?

4. A permanent patch in the alternative minimum tax (AMT) and a five-year extension of stimulus tax policies.?

The main sticking point is still what to do about the sequester. Stein and Grim report that both sides are still negotiating the cost of an extension of unemployment benefits and how to pay for a one-year resolution to postpone changes in Medicare payments to doctors.?

McConnell urged the Senate to move forward with the deal on taxes, while both sides continue negotiating on a deal to cut spending and avoid the sequester.

"Let's pass the tax relief portion now," McConnell said. "Let's take what's been agreed to and keep moving."?

"We?ll continue to work on finding smarter ways to cut spending but let?s not let that hold up protecting Americans" from tax hikes, he said.?

Several House Republican aides are now saying that a vote could still happen tonight, despite Cantor's announcement. Republican sources say members are being told to stay near the Capitol in case of a last-minute fiscal cliff vote.?

While it remains unlikely that a vote will be held tonight, it's worth noting that Republican House leaders moved Sunday to give themselves expedited authority to bring a vote to the floor in the event that the Senate passes a fiscal cliff bill Monday evening.

Facebook security glitch exposes users' New Year's Eve messages

Whew! Facebook saved countless users from?New Year's Eve humiliation ... after initially exposing their private messages.

Facebook's Midnight Delivery app allows users to schedule private messages to wish friends a happy new year exactly when the clock strikes twelve. This is fantastic for those who intend on having a glass of Champagne or five as 2013 approaches, as it will let them schedule a polite message along the lines of?"Happy New Year, my beloved friends!" instead of drunk texting everyone ?something like?"I'm sooooo wasted right nowljskf and happy NEW YeAr! 2013 FTW! YOLO!" when the ball in Times Square drops.

Now great as Facebook's little app sounds, there was?just one problem: A security glitch temporarily exposed users' scheduled?messages to the general public.

The Next Web's?Robin Wauters reports that?when a user scheduled a Midnight Deliveries?message, he or she was presented with a confirmation page. Unfortunately, that confirmation page could be viewed by anyone who happens to guess its URL. "You couldn?t see who sent the messages," Wauters explains, "but you could see all the intended recipients, and the message itself, if you tweaked the URL the right way."

Those toying around with URLs could also see images which were attached to those scheduled massages. And to add insult to injury, they could also delete the correspondences.

"We are working on a fix for this issue now," a Facebook spokesperson told NBC News via email. "[A]nd in the interim we have disabled this app on the Facebook Stories site to ensure that no messages can be accessed."

Perhaps the more prudent approach, for the time being, is to just plain type out a "Happy New Year!!!!1!!!" text message and send it to everyone in your contacts at midnight.
